Notice of Electronic Disclosure of Health Information

Texas Health and Safety Code Section 181.154(a) requires notice to each person whose protected health information is subject to electronic disclosure. This is that notice from DAS RFP, LLC, doing business as Casetrack.
2. What Casetrack holds
Casetrack is not a public service. It keeps electronic records for Texas providers of Medicaid waiver services, under a written agreement with each provider. If you receive services from a provider that uses Casetrack, your health information is held in Casetrack on that provider's behalf, and it is subject to electronic disclosure.
3. When it is disclosed electronically
Casetrack discloses your health information electronically only to your provider, which is responsible for your records; to the companies that host and support Casetrack for us, each of which has signed a written business associate agreement requiring the company to protect your information; and otherwise as state or federal law authorizes or requires, such as the limited uses federal privacy law allows for running Casetrack itself.
Any other electronic disclosure requires a separate authorization from you, or from your legally authorized representative, for each disclosure. We do not sell your health information, and we do not use it for marketing.
4. Your records
Your provider decides how your records are used, and answers your requests to see, copy or correct them, or for a list of their disclosures. If you send such a request to us, we pass it to your provider.
